Product Warranty

Mizar, Inc. (d.b.a. Pantanal Color Company), referred to herein as the publisher, guarantees that all software sold as Mizar Color Recipe
v 3.0.0.1, this version being the only version of Mizar Color Recipe sold at long as this text is posted, will be free of defects which prevent the program from functioning as represented by the publisher.

Any such software containing any such defects will be replaced with equivalent software free from such defects.

The publisher may decide to exercise an option, at the publisher's discretion, to issue a refund of purchase price instead of replacing software with such defects.  If the publisher chooses this option, such option will be exercised only after customer has been notified of publisher's decision and only after the return of all software materials, in tact.

The following "Warranty Disclaimer" and "Limit of Liability" are from the "License Agreement" which is included with the program. The publisher has adapted this wording as it closely conforms to the wording of "Warranty Disclaimers" and "Limit of Liability" clauses included in the license agreements of many other programs similarly marketed to the same trades.

THE AUTHORIZED PUBLISHER DOES NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN.
BY USING THE SOFTWARE OR DOCUMENTATION. THE AUTHORIZED PUBLISHER DOES NOT WARRANT THAT THIS SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE. THE AUTHORIZED PUBLISHER EXCLUDES AND EXPRESSLY DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

[LIMITATION OF LIABILITY]

THE AUTHORIZED PUBLISHER'S LIABILITY TO YOU FOR ANY LOSSES SHALL BE LIMITED TO THE DIRECT DAMAGES, AND SHALL NOT EXCEED THE AMOUNT YOU ORIGINALLY PAID FOR THE SOFTWARE. IN NO EVENT WILL THE AUTHORIZED PUBLISHER BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES(INCLUDING LOSS OF PROFITS) EVEN IF THE AUTHORIZED PUBLISHER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE AUTHORIZED PUBLISHER WILL NOT HAVE TO REPLACE A DISK DAMAGED BY ACCIDENT, ABUSE, OR MISAPPLICATION.
